Dear Link Parking,
I am writing this letter to appeal a ticket that was given to my vehicle (license plate AK47WWW) on Thursday 9th November 2017 (ticket reference number 4654654) at Barking Riverside.

I had a valid parking permit, as the parking signage required, however I forgot to display it on this occasion. I have now attached a copy of the parking permit with this appeal, for your consideration. 

In anticipation of any response you provide that rejects my appeal on the basis that the terms of your parking signage requires me not only to own a permit but also to display it, I consider this latter condition an unfair term under s62(1) of the Consumer Rights Act 2015 and so not binding upon me. There is no justification for including a term that precludes me from adducing evidence that I held a valid permit, where the effect of this is to enable you to profit from a mistake on my part. Inclusion of this term is also likely to constitute an unfair commercial practice under Regulation 3 of the Consumer Protection from Unfair Trading Regulations 2008 as no reasons of professional probity exist to deny me an appeal where I did own a valid permit, but simply failed to display it.


Furthermore, please provide me of evidence that you are the landowner; failing that please identify the landowner and provide a copy of your authority to issue the ticket on their behalf. Section 1.1, Part B of the IPC Code of Practice requires operators to own the land or to have written authority from the landowner to operate on the land. Reviewing the material available before me, you have failed to provide any evidence that you have the requisite authority to operate on the land in question.

For the reasons above the parking charge should be cancelled.
